Direct conveyancing news for Newcastle, Lake Macquarie, the East Coast and Hunter Valley.
WE ARE OPEN AND COVID-19 SAFE
Conveyancing Services are incredibly pleased to be a finalist in the Australian Small Business Champion Awards 2022!??
Merry Christmas from all of us at Conveyancing Services.
We close 24 December 2021 and reopen 10 January 2022!
A few members of our team had a great night out at Rustica with colleagues and the wonderful team from PEXA to celebrate the start of the Christmas season!
Congratulations to Natalie Mason on the birth of her second child Lachlan.
Today, 11 October 2021, new changes to the land titles system in NSW will be introduced that will transition NSW away from paper-based processes.
Existing Title Deeds will be cancelled and new Title Deeds will no longer be issued.
Chloe joined Conveyancing Services in May as our full time Administration Assistant. She is currently studying to obtain a Certificate 3 in Business Administration.
We are so grateful that she joined our team!
The Registrar General of NSW has declared that 11 October 2021 is the day on which all certificates of title (CTs) will be abolished, known as ‘cessation day’.
By order under section 33AAA of the Real Property Act 1900, from cessation day all current CTs have no legal effect and the Registrar General will no longer issue CTs for any reason.
New South Wales has experienced strong gains in property sales up 26% from this time last year!
In line with the NSW Government’s commitment to transition to 100% eConveyancing, the Real Property Amendment (Certificates of Title) Bill 2021 includes a proposal to abolish certificates of title (CTs).
The Bill passed the NSW Parliament on Tuesday 11 May 2021, with plans to completely remove paper titles by the end of 2021.
Existing CTs will be cancelled and CTs will no longer be issued.
With the passing of the Bill, eConveyancing will soon be the only method of conveyancing matters being settled.
Removing paper CTs is the final step in creating a seamless digital conveyancing environment. A digital land titles system is faster and more efficient and accurate.
Paper CTs of title are also easily lost, with around 4,500 replacement applications each year (costing the owners up to $500.00 each).
Benefits of the new system will include:-
• This step will strengthen and future-proof the system in NSW.
• Reducing the risk of settlement delays due to removing the need for paper CTs to settle property transactions or register dealings.
• Once paper CTs are abolished they will no longer be a legal document.
• Citizens holding CTs can keep the CT – there is no obligation to hand it in or destroy it.
The Bill allows the NSW Government to abolish CTs later this year.
The Federal Government has announced that they are establishing the First Home Guarantee, which is designed to help single parents with dependent children enter, or re-enter, the property market. 10,000 places will be made available over 4 years for eligible applicants to build a new home, or purchase an existing home, with as little as 2% deposit!
The recent budget announcement has some exciting news for First Home Buyers. The First Home Super Saver scheme introduced in 2017/2018 will be increasing the amount of voluntary contributions from $30,000 to $50,000 from July 1 2021!This scheme allows First Home buyers to save money for their first home inside their super fund.
News from the recent budget proposal states that purchasers who were eligible for the HomeBuilder Grant of up to $25,000 will now receive an extension from the construction commencement date from 6 months to 18 months!
“December 2020 recorded a two year high with 79,187 settlements taking place nationally, including 1,711 settlements on Christmas Eve with Australian consumers rushing to grab the keys before the New Year break.”
An extra 10,000 first-home buyers will be able to purchase with deposits as low as 5 per cent under an extension to the federal government’s First Home Loan Deposit Scheme. The extension only applies to newly built homes and comes with higher price caps. The extension to the scheme runs from October 6 to June 30, 2021.
We are excited to announce that we have become the very first firm to achieve the Conveyancing Best Practice Standard awarded by LEAP Legal Software AU!
The NSW Government has recently approved the cancellation of all paper Certificates of Title as part of the evolution of electronic conveyancing. It is expected that legislation to make this change will be introduced into Parliament later in the year and paper Certificates of Titles will be cancelled in around mid-2021.
It is important to help Australian small businesses and buy local as much as possible in these trying times. Conveyancing Services have always bought Australian made and owned, however we have made an extra effort recently to make sure we are buying local Newcastle & Maitland products and services.
All staff at Conveyancing Services have completed Mental Health Manager Training with the Black Dog Institute.
We take Mental Health concerns seriously, particularly in these trying times.
The Government’s HomeBuilder will provide eligible owner-occupiers (not just first home buyers) with a grant of $25,000 to build a new home or substantially renovate an existing home.
- HomeBuilder is a time-limited and demand-driven grant program to help the residential construction market to get through the COVID-19 pandemic.
- HomeBuilder will provide eligible owner-occupiers (not just first home buyers) with a grant of $25,000 to build a new home or substantially renovate an existing home where the contract is entered into between 4 June 2020 and 31 December 2020.
- Construction of a new home or substantial renovation must be contracted to commence within three months of the contract date.
- Consistent with the Morrison Government’s principles, the Scheme will be implemented through existing systems being the States’ respective Revenue Offices.
- HomeBuilder will complement existing State and Territory First Home Owner Grant programs, stamp duty concessions and other grant schemes, as well as the Commonwealth’s First Home Loan Deposit Scheme and First Home Super Saver Scheme.
To access HomeBuilder, owner-occupiers must meet the following eligibility criteria:
- you are an individual, not a company or trust;
- you are aged 18 years or older;
- you are an Australian citizen;
- you meet one of the following two income caps:
~ $125,000 per annum for an individual applicant based on 2018/19 tax return or later; or
~ $200,000 per annum for a couple based on your combined on 2018/19 tax return or later;
- you enter into a building contract between 4 June 2020 to 31 December 2020 to either:
~ build a new home as a principal place of residence valued up to $750,000 (including land); or
~ substantially renovate your existing home as a principal place of residence, with renovations valued at between $150,000 and $750,000 with the dwelling not valued at more than $1.5 million before the renovation;
- The respective revenue offices of each of the States will implement the Scheme and will use existing mechanism to mitigate the chances of fraud occurring.
- Owner-builders and those seeking to build a new home or renovate an existing home as an investment property are ineligible for HomeBuilder.
- Funding will go directly to individuals, not the contractors, and the individuals are committing a significant amount of investment themselves that this grant will complement.
- The forecast for the market means contractors will be operating in an environment with strong competition for work, ultimately helping drive lower prices.
- Renovations or building work must be undertaken by a registered or licenced building service 'contractor'
(depending on the state or territory you live in) and named as a builder on the building licence or permit. They must have held the building licence or endorsed contractor licence before the date of announcement.
- The registered or licensed builder (depending on the state or territory) must demonstrate that the contract price for the new build or substantial renovation be no more than a comparable product (measured by quality, location and size) as at 1 July 2019, if requested by the purchaser.
- In negotiating a building contact, the parties must deal with each other at arm’s length;
~ This means the contract must be made by two parties freely and independently of each other, and without some special relationship, such as being a relative.
~ The terms of the contract should be commercially reasonable and the contract price should not be inflated compared to the fair market price.
WHAT CAN BE RENOVATED USING HOMEBUILDER?
- The renovation works must be to improve the accessibility, safety and liveability of the dwelling.
- The renovation can be a combination of works (ie kitchen and bathroom renovation) but must be under the supervision of a registered or licenced builder.
WHAT CANNOT BE RENOVATED USING HOMEBUILDER?
- Homebuilder cannot be for used for additions to the property that are unconnected to the principle place of residence such as swimming pools, tennis courts, outdoor spas and saunas, and detached sheds or garages.
TIMING AND HOW TO APPLY
- More information on HomeBuilder, including eligibility, can be found on the Treasury Coronavirus Economic Response website.
- People will be able to apply for HomeBuilder when the relevant State or Territory Government that they live in, or plan to live in, signs the National Partnership Agreement.
- States and Territories will backdate acceptance of HomeBuilder applications to 4 June 2020. Applications will only be accepted up to and including 31 December 2020.
- Information on when and how you will be able to apply through the relevant State or Territory will become available in due course.
WHAT IF A CONTRACT HAS ALREADY BEEN SIGNED?
The Federal Government has advised that this would not be considered new work, even if the contract is terminated and a new contract entered into for the balance of the work. As the grants will be administered by the State and Territory Governments, the detail is still to be worked out, but this will be part of the criteria.

We were looking forward to catching up with him at our work Christmas party, because although he didn’t work with us anymore, he was still part of our family.
He was an amazing person, gone way too soon.
We will cherish the memories.

"In July Conveyancing Services had their usual volume of work but neither us or them knew what the day had installed for all of us. As it sometimes happens we experienced issues in being able to generate cheques via one of our client’s branch network. Daniel from Conveyancing Services pulled out all stops and went to three branches before being able to get the cheques. His “never say die” attitude saw him collect cheques in time and the matter resulted in a satisfied customer moving into their home. All in all he spent an hour driving between venues to make it happen. Our clients and us, are appreciative that such drive to “make it happen” exist out there with our agent network.
To Conveyancing Services and Daniel thank you!"
The Reserve Bank has decided to leave the cash rate unchanged again this month.

How amazing are these recent kind words from a client! So happy to hear our staff recognised for their awesome work. Well done Kat ~ I couldn't agree more!
And so happy to hear such great news for our client!
I just wanted to say a HUGE thank you to your office for all your assistance in the purchase of the above property. I was a little nervous all along that something might go wrong and I was assured by yourself and Kat at every melt down I had that all would be ok. And all was.
I would like you to give a special thank you to Kat. She went above and beyond what I would assume is her usual job description when we did run into some challenges.
I work in the customer service and sales industry and I know how painful the general public can be, she at no time made me feel ridiculous when I was having a melt down, she always assured me when she could. She is a rare find.
We picked up the keys this morning and went to have a look through together, oh and we got engaged this morning too. YAY!
How old were you when you bought your last property?
We have a client who is buying a home at the sweet age of 90 years old!
Have you looked at buying a property lately that said "offers over" an amount, just to find that it sells for $50k more than that amount!
New legislation is being introduced from January where agents are not allowed to use "offers over" or "offers above" in their marketing.
Hopefully this will stop agents who deliberately underquote expected sale prices to buyers.
The Reserve Bank have left the official rates on hold again this month.
Today we were proud to attend the official opening of The Levee Central Maitland

She is so sweet, that even after a very stressful matter she took the time to write us these kind words:
"My conveyancing settlement became unusual and the staff were very knowledgeable and gave good advice. They put my needs first at all times"
Official Rates have been left on hold again this month

Thanks WorkCover! We certainly take the safety of our staff, clients and business very seriously and are proud to be recognised as a small business who does. Especially after the storms we have had in the Hunter, we are glad that we were pre-organised with safety systems.
Our thoughts are with those who have been affected by the Hunter Storms. Property damage caused by natural disasters is an interesting area of our job, and we have spoken to some unfortunate clients this week who have suffered damage, but thankfully all have been safe. If a property you are buying or selling has been damaged, please contact our office so that we may discuss your options with you. Most importantly stay safe.
Our power and phones are back on at Adamstown! Huge shout out to Lewis who was amazing and so fast in helping us! Our main power unit was looking a bit singed after the storms!

Owners of Swimming Pools have been given another 12 months grace to have the pool inspected and passed by Council. A Pool Certificate of Compliance was to be mandatorily included in Contracts for sale from 29 April 2014. This was delayed to 2015 due to the high number of pool fails and slow inspections to give owners sufficient time, and the NSW State Government announced last week that the deadline has been extended again to commence on 29 April 2016.
The RBA have decided to leave the cash rate unchanged at 2.25 per cent
Great News for home buyers - the Reserve Bank of Australia have announced this afternoon that they have reduced the official cash rate by another 0.25%. This is a new 60 year low!!! Hopefully lenders will pass on this reduction.
"It's great to work with such positive people"
What perfect feedback to kick off 2015! Thank you Lozzie you've made our day.
It's here!!! I received a special package today with my digital signature for e-Conveyancing, so excited!!! So many of my clients ask why they have to get a bank cheque on settlement and wait 3 days for it to clear, such outdated technology. E-conveyancing will mean the money can go straight into their account electronically. I can't wait for the rollout to NSW!
You never know where our Tony Morris is going to turn up - maybe on the front page of The NSW Conveyancer Magazine.
Wishing you a very Happy New Year, may all your dreams come true in 2015! Both our offices are back open today, so if one of your dreams this year is to buy a new home, give us a call and we are ready to help you.
