Existing Title Deeds will be cancelled and new Title Deeds will no longer be issued.

Cessation Day

The Registrar General of NSW has declared that 11 October 2021 is the day on which all certificates of title (CTs) will be abolished, known as ‘cessation day’.

By order under section 33AAA of the Real Property Act 1900, from cessation day all current CTs have no legal effect and the Registrar General will no longer issue CTs for any reason.

New South Wales has experienced strong gains in property sales up 26% from this time last year!

In line with the NSW Government’s commitment to transition to 100% eConveyancing, the Real Property Amendment (Certificates of Title) Bill 2021 includes a proposal to abolish certificates of title (CTs).

The Bill passed the NSW Parliament on Tuesday 11 May 2021, with plans to completely remove paper titles by the end of 2021.

Existing CTs will be cancelled and CTs will no longer be issued.

With the passing of the Bill, eConveyancing will soon be the only method of conveyancing matters being settled.

Removing paper CTs is the final step in creating a seamless digital conveyancing environment. A digital land titles system is faster and more efficient and accurate.

Paper CTs of title are also easily lost, with around 4,500 replacement applications each year (costing the owners up to $500.00 each).

Benefits of the new system will include:-
• This step will strengthen and future-proof the system in NSW.
• Reducing the risk of settlement delays due to removing the need for paper CTs to settle property transactions or register dealings.
• Once paper CTs are abolished they will no longer be a legal document.
• Citizens holding CTs can keep the CT – there is no obligation to hand it in or destroy it.

The Bill allows the NSW Government to abolish CTs later this year.

The Federal Government has announced that they are establishing the First Home Guarantee, which is designed to help single parents with dependent children enter, or re-enter, the property market. 10,000 places will be made available over 4 years for eligible applicants to build a new home, or purchase an existing home, with as little as 2% deposit!

The recent budget announcement has some exciting news for First Home Buyers. The First Home Super Saver scheme introduced in 2017/2018 will be increasing the amount of voluntary contributions from $30,000 to $50,000 from July 1 2021!This scheme allows First Home buyers to save money for their first home inside their super fund.

News from the recent budget proposal states that purchasers who were eligible for the HomeBuilder Grant of up to $25,000 will now receive an extension from the construction commencement date from 6 months to 18 months!

An extra 10,000 first-home buyers will be able to purchase with deposits as low as 5 per cent under an extension to the federal government’s First Home Loan Deposit Scheme. The extension only applies to newly built homes and comes with higher price caps. The extension to the scheme runs from October 6 to June 30, 2021.

The NSW Government has recently approved the cancellation of all paper Certificates of Title as part of the evolution of electronic conveyancing. It is expected that legislation to make this change will be introduced into Parliament later in the year and paper Certificates of Titles will be cancelled in around mid-2021.

It is with a very heavy heart we must say goodbye to our good friend and past colleague Angus Lathan who passed away this weekend.
Angus worked with us for 2 years and surprised us in how quickly he learnt new skills, and was regularly praised by our clients for the way he took care of them.
We were looking forward to catching up with him at our work Christmas party, because although he didn’t work with us anymore, he was still part of our family.
He was an amazing person, gone way too soon.
We will cherish the memories.

We have had our old wooden windows ripped out and replaced with lovely new aluminum windows.
We are also getting new carpet and paint.

We are super thankful to our amazing painter who will be working over the long weekend to ensure the minimum disruption to our clients, what a legend!

Yay, we have completed our 100th Electronic Pexa Settlement today!!! 
And our 101st, 102nd, 103rd, 104th and 105th!!!Electronic Settlements allow for almost instant registration of the new owners name onto the title, and for electronic transfer of sale proceeds to the seller, rather than posting documents for Registration, and banking cheques and waiting for the funds to clear.Being an early adopter, we have had both good and bad experiences with the Pexa platform, but its getting better every day!

The information recorded at the police station helps contact their GP and/or person to contact when there is an emergency situation.
The person is provided with a key ring which will assist when they are out in the community and a sticker to be placed on the home phone or fridge.

The Government has announced they will reintroduce the exemption from paying stamp duty for properties up to $650,000 and a discount on stamp duty for properties up to $800,000.

Tonight I was presented with a medal for being a Finalist for the Newcastle Herald Hunter Water - Hunter Hero Awards.
I missed the actual presentation because I had a client call at 5pm who was in a race with another buyer to secure a property, so I stayed and we were able to help him buy his dream house.
Going above and beyond for clients is how we have made it through 30 years of business, and that's the reason we were getting the award so it seemed fitting.

Today we completed our first electronic settlement on PEXA!
I can't honestly say it was as smooth as I would have liked, the Land Titles Offices servers were down so the time had to be pushed back 3 times and eventually settled at 5.15pm. 
Unfortunately new technology often has some hiccups, but it takes people being willing to be the early adopters to help 'iron out the kinks' and get it perfect, and we are happy to be involved in that, as it is surely the way of the future.

Have you looked at buying a property lately that said "offers over" an amount, just to find that it sells for $50k more than that amount!
New legislation is being introduced from January where agents are not allowed to use "offers over" or "offers above" in their marketing.
Hopefully this will stop agents who deliberately underquote expected sale prices to buyers.
